WHO CAN JOIN THE CLAIM?

Eligible claimants with a valid claim who have purchased or leased an impacted diesel from across Europe are welcome to join, even if you are no longer in possession of the affected vehicle. To see a list of all the specific makes and models, please click here.

If you own (or owned) a fleet of these vehicles for your business, you may also be eligible. Please see additional details for fleet owners.

HOW DO I JOIN?

To join this group action, you only need to agree to our terms by.completing the simple sign-up process on this website and provide us with proof of identification and proof of vehicle ownership.

WHAT WILL IT COST ME?

There is no up-front cost to join the claim and we operate on a no win, no fee basis. You will not have to pay anything to assert your rights. Only if we manage to get you financial compensation, you will pay a fee.to the funder of up to 27.5% (VAT included, if applicable) of the financial compensation. This percentage can also be lower, depending on various circumstances.

HOW MUCH COMPENSATION WILL I GET?

Ultimately, the amount of compensation you may receive will either be negotiated through a settlement or determined by the Court but we.expect it to be in the thousands of euros. This action is important not just to get financial compensation, but also to hold Fiat Chrysler Automobiles.accountable for their unfair commercial practices and the resulting damage to the environment.

WHAT DOCUMENTS AND INFORMATION DO I NEED TO PARTICIPATE IN THE CLAIM?

To participate in the claim, you will need to upload an official form of identification.along with your proof of ownership. – this can be your registration card or purchase -or sales documents and needs to contain your VIN or chassisnumber and to sign the Participation Agreement.

CAN I JOIN THE CLAIM IF I NO LONGER OWN OR LEASE MY CAR?

Yes. Even if you no longer own or lease your vehicle, or if you bought it second hand, you may be eligible for compensation. Please check your vehicle’s eligibility and register.

HOW LONG WILL LITIGATION TAKE?

While it is difficult to predict how long it will last, it is anticipated this lawsuit will take at least 2-3 years to get a final decision of the court. Should we be able to reach an amicable settlement with FCA during the course of litigation, it will be much quicker, although additional time may be required in order to obtain court approval for a settlement. In case additional litigation is required outside the Netherlands, it may take several years before results may be reached.

CAN I WITHDRAW MY REGISTRATION WITH THE FOUNDATION?

Yes. You can cancel your registration anytime, just contact us at claim@fca.dieseljustice.com and we will cancel your registration. However if you already concluded the contract with the Foundation you have 14 days to withdraw with no reason necessary. After that, if you wish to cancel your participation with the Foundation, you must give 30 days’ notice and send an email request to claim@fca.dieseljustice.com. Should the Foundation come to a settlement agreement with Fiat Chrysler Automobiles or should a positive outcome be reached with the courts, you will no longer be able to cancel. This is fair, because at that moment we will have delivered results benefitting you.

DOES REGISTRATION WITH THE FOUNDATION INTERRUPT THE STATUE OF LIMITATIONS?

Registration with the Foundation will not, by definition, interrupt the statute of limitation for car owners who purchased or leased their vehicle outside the Netherlands. The Foundation will at the same time do everything it reasonably can, on a best effort basis, in order to interrupt the statute of limitation on your behalf.

DOES IT MATTER IF I AM ALREADY PARTICIPATING WITH ANOTHER FOUNDATION OR IF I AM ALREADY INVOLVED IN LEGAL PROCEEDINGS?

Yes. If you are already a part of another organisation or have begun legal proceedings separately, you are not able to join our foundation without revoking the other membership first or withdrawing from the other proceedings.

WHAT IS STICHTING DIESEL EMISSIONS JUSTICE?

Stichting Diesel Emissions Justice is the legal name of Diesel Emissions Justice Foundation (DEJF) and is a non-profit foundation established under Dutch law. Theirs unique structure and purpose allow them to represent all impacted Europeans and maximize pressure with the final goal of obtaining compensation for you.
